  36. ON A ROYALTY FREE BASIS. CONTINUED USE AFTER EVALUATION IS CONDITIONED
  37. UPON PAYMENT BY USER OF THE REGISTRATION FEE SPECIFIED IN THE FILE:

  40. 1. LICENSE GRANT. McAfee grants to you a non-exclusive, non-transferable
  41.    right to use the SOFTWARE on file servers connected to a maximum
  42.    number of user computers, or on a maximum number of user computers,
  43.    not exceeding the number of user computers specified on the packaging
  44.    for this product. This license to use the SOFTWARE is conditioned
  45.    upon your compliance with the terms of this Agreement. You agree you
  46.    will only copy the SOFTWARE into any machine-readable or printed form
  47.    as necessary to use it in accordance with this license or for backup
  48.    purposes in support of your use of the SOFTWARE. This license
  49.    is effective until terminated. You may terminate it at any point by
  50.    destroying the SOFTWARE together with all copies of the SOFTWARE.
  51.    Also, McAfee has the option to terminate if you fail to comply with
  52.    any term or condition of this Agreement. You agree upon such
  53.    termination to destroy the SOFTWARE together with all copies of
  54.    the SOFTWARE.

  56. 2. COPYRIGHT. The SOFTWARE is protected by United States copyright law
  57.    and international treaty provisions. You acknowledge that no title to
  58.    the intellectual property in the SOFTWARE is transferred to you. You
  59.    further acknowledge that title and full ownership rights to the
  60.    SOFTWARE will remain the exclusive property of McAfee or its
  61.    suppliers, and you will not acquire any rights to the SOFTWARE
  62.    except as expressly set forth in this license. You agree that any
  63.    copies of the SOFTWARE will contain the same proprietary notices
  64.    which appear on and in the SOFTWARE.

  66. 3. REVERSE ENGINEERING. You agree that you will not attempt to reverse
  67.    compile, modify, translate, or disassemble the SOFTWARE in whole or
  68.    in part.
  69.  
  70. 4. LIMITED WARRANTY. McAfee warrants that the SOFTWARE will perform
  71.    substantially in accordance with the accompanying written materials
  72.    for a period of thirty (30) days from the date of purchase. Any
  73.    implied warranties relating to the SOFTWARE are limited to thirty
  74.    (30) days.

  76. 5. CUSTOMER REMEDIES. If the SOFTWARE does not conform to the limited
  77.    warranty in Section 4 above ("Limited Warranty"), McAfee's entire
  78.    liability and your sole remedy shall be, at McAfee's option, either
  79.    to (a) correct the error or (b) help you work around or avoid the
  80.    error. The Limited Warranty is void if failure of the SOFTWARE has
  81.    resulted from accident, abuse, or misapplication. Any replacement
  82.    SOFTWARE will be warranted for the remainder of the original Limited
  83.    Warranty period.

  85. 6. NO OTHER WARRANTIES. McAFEE DOES NOT WARRANT THAT THE SOFTWARE IS
  86.    ERROR FREE. EXCEPT FOR THE EXPRESS LIMITED WARRANTY IN SECTION 4
  87.    ("LIMITED WARRANTY"), McAFEE DISCLAIMS ALL OTHER WARRANTIES WITH
  88.    RESPECT TO THE SOFTWARE, EITHER EXPRESS OR IMPLIED, INCLUDING BUT
  89.    NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR
  90.    A PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS.
  91.    SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES
  92.    OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY MAY LAST, OR THE
  93.    EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES,
  94.    SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
  95.    THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO
  96.    HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION.

  98. 7. SEVERABILITY. In the event of invalidity of any provision of this
  99.    license, the parties agree that such invalidity shall not affect the
  100.    validity of the remaining portions of this license.

  102. 8. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL McAFEE OR
  103.    ITS SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL,
  104.    INCIDENTAL OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE
  105.    DELIVERY, PERFORMANCE OR USE OF THE SOFTWARE, EVEN IF McAFEE HAS
  106.    BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT
  107.    WILL McAFEE'S LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT,
  108.    TORT OR ANY OTHER THEORY OF LIABILITY, EXCEED THE LICENSE FEE
  109.    PAID BY YOU, IF ANY.
  110.  
  111. 9. GOVERNING LAW. This license will be governed by the laws of the
  112.    State of California as they are applied to agreements between
  113.    California residents entered into and to be performed entirely
  114.    within California. The United Nations Convention on Contracts
  115.    for the International Sale of Goods is specifically disclaimed.

  117. 10.ENTIRE AGREEMENT. This is the entire agreement between you and
  118.    McAfee which supersedes any prior agreement or understanding,
  119.    whether written or oral, relating to the subject matter of this
  120.    license.

  122. U.S. GOVERNMENT RESTRICTED RIGHTS
  123. If this product is acquired under the terms of a (i) Civilian Agency
  124. Contract - use, reproduction or disclosure is subject to
  125. FAR 52.227-19(a) through (d) and restrictions set forth in the
  126. accompanying end user agreement; and (ii) DoD Contract - use,
  127. duplication or disclosure by the Government is subject to the
  128. terms of this license unless superseded by 252.227-7013(c)(1)(ii).
